Acceptance of Terms

By booking our services, attending training sessions, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our services or website. These terms constitute a legally binding agreement between you and LunarTitanium B.V.

Services Description

LunarTitanium provides personal training services including:

• One-on-one personal training sessions
• Small group training sessions
• Fitness assessments and evaluations
• Customised workout programme design
• Nutrition guidance and advice
• Ongoing fitness support and motivation

All services are provided by qualified and certified personal trainers. Service availability, schedules, and specific offerings may vary and are subject to trainer availability and facility capacity.

User Obligations

As a client of LunarTitanium, you agree to:

• Health Disclosure: Provide accurate and complete information about your health, medical conditions, injuries, and fitness history
• Medical Clearance: Obtain medical clearance from a healthcare professional before beginning any fitness programme if you have any health concerns
• Safety Compliance: Follow all safety instructions and guidelines provided by your trainer
• Punctuality: Arrive on time for scheduled appointments and provide at least 24 hours' notice for cancellations
• Payment: Pay all fees promptly according to the agreed payment terms
• Respectful Behaviour: Treat our staff, facilities, and other clients with respect and courtesy
• Facility Rules: Comply with all facility rules and regulations
• Personal Property: Take responsibility for your personal belongings and valuables

Health and Safety

You acknowledge that physical exercise involves inherent risks of injury. You participate in all training activities at your own risk and agree to immediately inform your trainer of any discomfort, pain, or concerns during sessions. You are responsible for consulting with a healthcare professional before beginning any fitness programme, especially if you have any medical conditions, injuries, or health concerns. LunarTitanium trainers are not medical professionals and cannot provide medical advice, diagnosis, or treatment.

Payment Terms

Payment terms include:

• Payment is due at the time of booking unless other arrangements have been made
• We accept various payment methods including bank transfers, credit cards, and cash
• Package deals and memberships must be paid in full before services begin
• Late payment fees may apply for overdue accounts
• Refunds are handled according to our cancellation and refund policy
• All prices are in Euros and include applicable VAT

Cancellation and Refund Policy

Cancellations must be made at least 24 hours in advance to avoid charges. Sessions cancelled with less than 24 hours' notice will be charged at the full session rate. In case of emergency or illness, exceptions may be made at our discretion. Refunds for unused sessions in packages may be provided on a case-by-case basis, minus any applicable administrative fees. No refunds will be given for completed services or after 30 days from the original purchase date.

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of LunarTitanium B.V. and is protected by copyright and other intellectual property laws. Training programmes, methodologies, and materials developed by LunarTitanium are proprietary and confidential. You may not reproduce, distribute, modify, or create derivative works from any of our intellectual property without explicit written permission. You are granted a limited, non-exclusive licence to access and use our website and training materials solely for personal, non-commercial purposes.

Privacy and Data Protection

Your privacy is important to us. The collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

Limitation of Liability

To the maximum extent permitted by law, LunarTitanium B.V., its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services or website. This includes, but is not limited to, damages for personal injury, loss of profits, business interruption, or loss of information. Our total liability for any claim arising from these Terms or our services shall not exceed the amount paid by you for the specific service giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless LunarTitanium B.V., its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Dutch courts. If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The failure to enforce any provision of these Terms shall not constitute a waiver of such provision or any other provision.

Termination

Either party may terminate the service relationship at any time with reasonable notice. LunarTitanium reserves the right to terminate services immediately if you violate these Terms, engage in inappropriate behaviour, or fail to meet your obligations. Upon termination, you remain liable for any outstanding payments, and any unused prepaid services may be refunded at our discretion, minus applicable fees. Provisions of these Terms that by their nature should survive termination shall continue in effect after termination.

Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on our website with an updated "Last updated" date. Your continued use of our services after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically to stay informed of any updates.

Force Majeure

LunarTitanium shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government actions, pandemics, strikes, or other unforeseeable events. In such cases, we will make reasonable efforts to resume services as soon as possible.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and LunarTitanium B.V. regarding the use of our services and supersede all prior and contemporaneous agreements, whether written or oral, relating to the subject matter herein.
